The subject of  the "user-payer"

    The principle “user-payer” is not a novelty in another countries legislation, because it exists in Germany since the beginning of the century, and since 1964 in France, and it is also one of the requests of admission in the European Common Market.
    However, in spite of the subject being new for us, we can say in general terms that the charge for the water’s utilization has these finalities:
- Conscious about its importance and that it is a renewable product, but it finishes;
- Decrease of its consume; provide economical subsidies for its own management;
- Incentive the rational utilization because of its captivation decrease and the possibility of an equal distribution;
- Contribute on the process for getting a sustainable development.
   However, for occuring it, it is necessary studying and adopting a hydrical resources management following these:
-  adequate planning observing the region’s peculiarities and of soil occupation;
- maintenance of the equipment in good conditions for avoiding waste;
- take rational advantage of hydrical resources; incentive the reuse and recycle of water;
- promote international interchange, because there are hydrographic bowls that have its extension up to another countries;
- celebrate partners between Counties and State related to water management;
- incentive the society’s participation;
- distribute water considering the social necessities and economical necessities;
- supervise energetically because of the possibility of existence of powerful polluters  economically and politically;
- promote the environmental education with emphasis in the pollution of this resource;
- provide didactic material about the subject, accessible to all the scholar levels;
- study, review, and propose changes on the criminal legislation for effective sanction for the polluter etc.
    Therefore, we have been seen a big preoccupation of technicians in hydrical resources and enterprises with the industrial utilization of water, as we can see in the articles that are published in specialized magazines.
    The legal prevision of the “payer-user” is at the Law nº 9.433/97.
